Notice

WebStatik is currently provided free of charge so that interested users can access the platform's features and capabilities. The platform is still under development, and technical errors may therefore occur.

WebStatik should therefore not currently be used as the sole basis for structural calculations in the design of actual construction projects. Calculation results must always be independently reviewed and verified by a qualified professional before being used.

These terms and conditions (the "Terms") apply to the use of the websites, web applications and software services (the "Service") provided by:

WebStatik ApS

CVR 46231139

In these Terms:

•

•

"Personal Data" means information relating to an identified or identifiable natural person.

Customer Data may contain Personal Data. The fact that information is Personal Data does not in itself change its status as Customer Data under these Terms.

2.3. You must inform us immediately if you become aware of unauthorised access to your account.

3. Customer Data and projects

3.1. Data, projects, calculations, inputs, documentation and other material that you or your company create or upload to the Service ("Customer Data") remain the property of you or your company.

3.2. You grant us the right to store, process, copy and otherwise handle Customer Data to the extent necessary to provide, maintain, secure, troubleshoot and support the Service.

3.3. You are responsible for having the necessary rights and permissions to enter or upload Customer Data to the Service.

3.4. We may use anonymised and aggregated information about use of the Service for statistics, troubleshooting, security and further development of the Service. Such information must not be attributable to an identified or identifiable person or customer.

3.5. Customer Data may be stored by us or our subcontractors, including cloud, hosting and infrastructure providers, where necessary to provide the Service.

3.6. If Customer Data contains Personal Data, the processing of that Personal Data may be subject to a data processing relationship between the customer and WebStatik. Where relevant, this relationship is governed by a separate data processing agreement.

3.7. WebStatik does not use Customer Data for its own purposes outside the provision, operation, maintenance, security and support of the Service, unless otherwise provided by these Terms, a separate agreement or applicable law.

4. Calculations and professional responsibility

4.1. The Service has been developed as a professional tool for structural engineering consultancy and performs calculations using the methods and models implemented in the Service.

4.2. The user is responsible for ensuring that the information entered and assumptions selected are correct and relevant to the particular project, and that the calculation method selected is suitable for its purpose.

4.3. Calculation results must be included in the user's normal professional review and quality assurance before being used as a basis for design, documentation for authorities or construction.

5. Permitted use

5.1. The Service may only be used lawfully and in accordance with these Terms.

5.2. You must not:

•

attempt to gain unauthorised access to the Service or other users' data.

6. Intellectual property rights

6.1. The Service, including software, source code, calculation engines, algorithms, user interface, design, documentation, graphics, trademarks and other content, belongs to us or our licensors.

6.2. These Terms do not grant you ownership of the Service or its intellectual property rights.

6.3. You retain the rights to your Customer Data that you held before uploading or creating it in the Service, and you may use calculation results and other output from the Service for your normal business purposes.

7. Availability

7.1. The Service may occasionally be temporarily unavailable due to maintenance, updates, technical problems, security incidents, failures at third-party suppliers or other circumstances beyond our reasonable control.

8. Limitation of liability

8.1. To the fullest extent permitted by applicable law, the Service is provided "as is".

8.2. We are not liable for indirect loss or consequential damage, including loss of profit, revenue, business opportunities, goodwill or anticipated savings.

8.3. We are not liable for losses resulting from incorrect or incomplete information entered by the user or from a lack of review and professional assessment of calculation results.

8.4. To the maximum extent permitted by law, our total liability for claims relating to the Service is limited to the subscription fees paid to us by the customer in the 12 months preceding the event giving rise to the claim.

8.5. Where a free version of the Service is used, the user accepts that the Service is used at the user's own risk. In such cases, we accept no liability for loss or damage arising from access to or use of the Service, including use of calculation results or other output from the Service, to the extent that such liability may lawfully be excluded.

9. Termination and suspension

9.1. The customer may terminate their subscription in accordance with the applicable subscription terms.

9.2. We may suspend or close an account if the customer materially breaches these Terms, fails to pay for the Service, or uses the Service in a way that poses a security risk or otherwise materially harms the Service or other users.

9.3. The right to use the Service ends when the subscription ends.

9.4. After termination, Customer Data may be deleted in accordance with our applicable procedures. The customer is therefore responsible for securing any data that the customer is required to retain or wishes to preserve.

9.5. If Customer Data contains Personal Data that WebStatik processes on the customer's behalf as a data processor, deletion or return of that Personal Data is handled in accordance with the relevant data processing agreement and applicable data protection law.

10. Personal Data

10.1. We process Personal Data in connection with operating and administering the Service, including administration of user accounts, support, security and invoicing.

10.2. Our processing of Personal Data where WebStatik is the data controller is described in more detail in our Privacy Policy.

10.3. Processing of Personal Data that the customer enters or uploads as part of Customer Data, and which WebStatik processes on the customer's behalf, is governed by the relevant data processing agreement and these Terms, rather than the Privacy Policy.
