hereinafter referred to as "we", "us" or "our".

This Privacy Policy applies to the Personal Data processed by WebStatik where WebStatik is the data controller. Processing of Personal Data that a customer enters or uploads as part of Customer Data, and which WebStatik processes on the customer's behalf, is governed by the relevant data processing agreement and is not covered by this Privacy Policy.

1. Data controller

WebStatik ApS is the data controller for the personal data we process in connection with administering user access, communicating with users and operating the Service.

2. What personal data do we process?

When creating and administering a user account, we process the user's name, email address and information about the user's association with a company and access to the Service.

In connection with company licences, we may process information about the company name and company domains associated with the company.

In connection with payment, we may process information necessary for invoicing and subscription administration. For card payments, payment card details are handled by our external payment provider. WebStatik does not store payment card details unless separately stated.

We may also process technical information necessary for operation, security and troubleshooting, such as IP addresses, access times and technical logs.

3. What do we use personal data for?

We process personal data to:

•

create and administer user accounts.

•

administer access to company licences.

•

provide and operate the Service.

•

provide support and respond to enquiries.

•

secure the Service and prevent misuse.

•

identify and address technical errors.

•

administer payments and invoicing.

•

comply with our legal obligations.

We do not use personal data for marketing unless this is based on a separate legal basis.

4. Legal basis for processing

We process personal data on the basis of the rules set out in the General Data Protection Regulation (GDPR) and other applicable data protection legislation.

Depending on the purpose, processing may, among other things, be necessary to perform an agreement with the user or the customer's company, to comply with a legal obligation, or to pursue our legitimate interests in, for example, the secure, stable and efficient operation of the Service.

5. Where is the information stored?

Personal data is stored on secure servers at WebStatik and our data processors and may be processed in connection with operation, hosting, backup and maintenance of the Service.

We use external suppliers for hosting, infrastructure and other technical services where necessary to provide and operate the Service.

In certain cases, personal data may be processed outside the EU/EEA where necessary to use a relevant supplier. In such cases, we ensure that processing complies with applicable data protection rules and is based on a lawful transfer mechanism.

6. Payment

We use an external payment provider for card payments.

Payment card details are handled by the payment provider and are not stored by WebStatik unless specifically stated otherwise.

The payment provider processes personal data in accordance with its own terms and privacy policy.

7. How long do we retain the information?

We retain personal data for as long as necessary for the purpose for which it was collected, or for as long as we are required to do so by applicable law.

As a general rule, user and account information is retained for as long as the user account or relevant customer relationship exists.

When a user or customer no longer has an active account, we delete or anonymise Personal Data when there is no longer a legitimate need to retain it, unless we are required to retain it for longer.

Information that we are required by law to retain, including information relating to bookkeeping and invoicing, is retained for the period required by law.

Technical logs may be retained for a limited period where necessary for operation, security and troubleshooting.

Customer Data, including any Personal Data within Customer Data, is not covered by the general deletion rules in this section. If WebStatik processes such Personal Data on the customer's behalf, retention and deletion are governed by the relevant data processing agreement and applicable contractual terms.

8. Who do we share the information with?

We may grant our data processors and other suppliers access to personal data where necessary to operate, maintain, secure and support the Service. This includes suppliers of hosting and IT infrastructure, payment processing, email and communications, support and technical operations, security, backup and troubleshooting.

We do not sell personal data to third parties.

9. Customer Data and Personal Data processed on the customer's behalf

Customers may enter or upload Customer Data to the Service. Customer Data may in some cases contain Personal Data.

When WebStatik processes Personal Data that a customer has entered or uploaded to the Service on the customer's behalf and under the customer's instructions, the customer is generally the data controller and WebStatik acts as the data processor. This processing is governed by the relevant data processing agreement between the customer and WebStatik.

The customer is responsible for having a lawful basis for processing Personal Data that the customer enters or uploads to the Service, and for providing data subjects with the information that the customer is required to provide under data protection legislation.

WebStatik processes such Personal Data only to the extent necessary to provide, operate, maintain, secure and support the Service, and in accordance with the relevant data processing agreement.

Information about WebStatik's security measures, use of subprocessors, deletion or return of Personal Data and other matters relating to processing as a data processor is governed by the relevant data processing agreement.
